HC holds youngest son eligible for appointment


CHENNAI: The youngest son is also eligible for appointment on compassionate grounds, said the Madras High Court on Thursday.

R Amudha's husband died while working as watchman in a panchayat union school in Villupuram in 1991. She applied for appointment to her son, Gunasekaran and the District Education Officer (DEO), Villupuram, on September 7, 2007, rejected the plea.

Hence, the present writ petition. Disposing of the petition, Justice N Paul Vasanthakumar referred to an earlier decision of a division bench of the High Court, which stated that a choice was given to make an application both to the senior most eligible person or a qualified person.


The word "or" had to be treated as disjunctive. Moreover, the scheme of compassionate appointment was one made for the social benefit of the poor and indigent families, the bench said.Based on the judgment, Justice Kumar directed the DEO to consider petitioner's request afresh and pass appropriate orders within four weeks.
